General Terms and Conditions (GTC)
B2W GmbH – EVENT · HOSPITALITY · MOBILITY · PROMOTION
Effective: July 2025
1. Scope
These General Terms and Conditions apply to all services provided by B2W GmbH, Oberföhringer Straße 186, 81925 Munich (hereinafter 'B2W'), in particular in the areas of transportation, event logistics, chauffeur services, and other mobility, hospitality, and promotion services. Deviating terms and conditions of the client shall not apply unless B2W has expressly agreed to them in writing.
2. Contract Formation
A contract is formed either through written confirmation by B2W or through the actual use of the service. Offers are non-binding. The client is obliged to provide all necessary and correct information required for service execution.
3. Scope of Service & Pickup Conditions
The scope of service is determined by the booking confirmation. Pickup times are considered agreed upon if confirmed in writing or in text form. Changes (e.g. flight times) must be communicated to B2W in good time. B2W is not liable for delays resulting from incomplete or delayed information.
4. Prices & Payment Terms
Current prices are based on the valid price list or a written offer. Payments are due without deduction upon receipt of invoice. B2W reserves the right to request advance payment for new or large-scale clients. In case of payment delay, B2W may charge statutory interest and dunning fees (€15 for level I / €25 for level II).
5. Cancellations & No-Show Charges
The client may cancel the contract at any time. The following flat-rate cancellation fees apply:
- up to 48 hours before the scheduled start: free of charge
- 48 to 24 hours before: 50% of the total amount
- less than 24 hours or in case of no-show: 100% of the total amount
Individual agreements, especially for events or multi-day bookings, remain unaffected.
6. Passenger Obligations & Conduct
Passengers must wear seat belts during the ride. Instructions given by the chauffeur must be followed. The client is liable for damages caused by improper conduct, intentional soiling, or improper handling of luggage. Smoking (including e-cigarettes), alcohol consumption, and eating are only permitted with prior agreement.
7. Liability & Warranty
B2W is liable only for intent or gross negligence. For minor negligence, liability is limited to twice the fare. No liability for delays caused by force majeure, traffic, weather, demonstrations, or official orders. Clients are liable for damages caused by transported items, animals, or minors under their supervision.
8. Data Protection
Personal data is used solely for contract fulfillment and processed in accordance with GDPR. Disclosure to third parties only occurs if necessary to fulfill the contract.
9. Jurisdiction & Applicable Law
German law shall apply exclusively. Jurisdiction is Munich, if the client is a merchant, a legal entity under public law, or a special fund under public law.
10. Severability Clause
If any provision is or becomes invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes closest to the intended purpose.
11. Concierge and Mediation Services
B2W offers concierge services (e.g., reservations, errands, third-party service mediation). There is no entitlement to a specific result. For third-party services (e.g., hotels, restaurants), only the respective provider is liable, unless B2W acts with gross negligence or intent. Clients must provide complete and timely information.
12. Event & Promotion Services
For event planning, promotion, or logistical services (e.g., driver coordination, personnel, locations), services are performed according to the booking. Results (e.g., participant numbers, media impact) are not guaranteed. Liability for failures of external partners is excluded unless B2W acted with gross negligence or intent. The client ensures access to venues and required cooperation.
13. Confidentiality
B2W and the client agree to maintain strict confidentiality regarding all personal or business information acquired during the service period. This obligation remains in effect beyond the end of the contract.
14. Data Processing & Third-Party Transfers
The client consents to the processing and possible transfer of personal data (e.g., name, flight or payment information) required to fulfill the service. B2W ensures GDPR-compliant processing and will provide proof of data processing agreements with third-party providers upon request.
